In these terms and conditions, “we” “us” and “our” refers to Handyben Pty Ltd trading as Bloody Good Mattresses. Your access to and use of all information on this website including purchase of our product/s is provided subject to the following terms and conditions.
We reserve the right to amend these Terms and Conditions at any time and use of the website following any amendments represents agreement to be bound by these terms and conditions as amended.
1. Introduction
These Terms and Conditions govern the sale of products by Handyben Pty Ltd trading as Bloody Good Mattresses (“we”, “us”, “our”) to you (“customer”, “you”).
By purchasing from us, you agree to these Terms.
Nothing in these Terms excludes your rights under the Australian Consumer Law.
2. 180 Night Comfort Swap Guarantee
2.1 Trial Period
All Bloody Good Mattresses include a 180 night comfort swap guarantee, commencing from the date of delivery.
2.2 Minimum Trial Requirement
You must trial your mattress for a minimum of 21 nights before requesting a swap.
This allows:
- Your body to adjust to the mattress
- The mattress to adjust to your body’s natural contours
2.3 No Refunds – Exchange Only
There are no refunds under the 180 night comfort guarantee.
If the firmness is not suitable, you may request one replacement mattress only within the 180 night period.
2.4 Swap Conditions
- Only one swap per original purchase
- Replacement must be equal or greater value (price difference payable if applicable)
- We cover collection and delivery costs (excluding remote area conditions below)
- Mattress must be in good, hygienic condition
2.5 Incorrect Size Purchases
If you ordered the wrong size and have unpacked the mattress, you may exchange it. You must pay any price difference.
We strongly recommend measuring your bed frame prior to purchase (width, length and height).
2.6 Swap Process
If you wish to initiate a swap:
- Contact us within 180 nights
- We coordinate collection through a charity partner or recycling team
- Once collection is confirmed, your replacement mattress will be dispatched
- We coordinate timing so you are not left without a mattress
If you live in a remote area, you may be required to donate the mattress directly to a local charity.
2.7 Returned Mattress Handling
- Most returned mattresses are donated to charity
- Where donation is not possible, products are professionally recycled
- We never re-sell returned mattresses
3. Warranty
3.1 15 Year Warranty
We provide a 15 year warranty on our mattresses.
3.2 What the Warranty Covers
The warranty covers excessive body imprints only.
If, under normal use, a body impression exceeds 35mm in depth, we will assess the mattress as a potential warranty claim.
3.3 What Is Not Covered
The warranty does not cover:
- Normal body impressions up to and including 35mm
- The break-in period where the mattress conforms to your body
- Changes in firmness preference
- General wear and tear
- Damage from moving or rotating the mattress
- Tears caused while handling
- Abnormal use or abuse
- Odour (natural material scent)
- Sheet fit issues
- Soiled or stained mattresses
- Minor manufacturing anomalies repairable by minor sewing
- Commercial, rental or business use (including hotels and Airbnb)
For commercial or rental use, the warranty period is limited to 12 months.
4. Bed Base Requirements
The mattress must be used on a suitable bed base.
Incorrect or unsupported bases will void the warranty.
Unsuitable bases include:
- Broken or bowed slats
- Slats spaced excessively apart
- Inadequate centre support
- Old or sagging bases
- Non-flat support surfaces
We reserve the right to request photos of the base during assessment.
5. Warranty Assessment and Remedy
Bloody Good Mattresses reserves the right to:
- Repair the mattress
- Replace the mattress
- Offer a similar replacement if discontinued
If a product is discontinued, we reserve the right to offer a similar replacement product.
Claims must include:
- Proof of purchase
- Photographs
- Measurement of body impression without bedding
The warranty does not cover:
- Normal body impression. A mattress has a break in period where it will conform to your body’s natural contours and weight. Essentially individualising itself to you. Up to and including 35mm is perfectly normal and is not covered under the warranty
- Changes in firmness preference. If over the course of use you find you are not sleeping well due to a firmness or feel issue, this is not covered under the warranty
- General wear and tear
- Damage arising from shifting or moving the mattress. E.g. if you tear or rip any of the seams while rotating the mattress, changing the sheets or moving it in general.
- Damage arising from abnormal use, or abuse
- Odour (some of the materials used have a natural odour)
- Sheet fit
- Soiled mattresses
- Minor manufacturing anomalies e.g. a small tear that can be fixed with minor hand sewing
- Use for commercial, rental or other business purpose (including but not limited to hotel use, Airbnb etc.). In such cases the warranty period is 12 months.

7. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for reasonably foreseeable loss or damage.
You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
8. No Refund Policy
Except where required under Australian Consumer Law:
- There are no refunds for change of mind
- There are no refunds under the 180 night comfort guarantee
- Only one exchange is permitted
9. Limitation of Liability
To the extent permitted by law:
- Our liability is limited to repair or replacement
- We are not liable for indirect or consequential loss
10. Governing Law
These Terms are governed by the laws of Australia and the relevant State or Territory of purchase.
Indemnity
By accessing our website, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website. Force Majeure
If a Force Majeure event causing delay to our supply or delivery to you continues for more than 14 days, we may terminate this Agreement by giving at least 7 days Notice to you. “Force Majeure” means any act, circumstance or omission over which we could not reasonably have exercised control. Jurisdiction
These terms and conditions are to be governed by and construed in accordance with the laws of Victoria and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in Victoria.
If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary, the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.
Privacy
We undertake to take all due care with any information which you may provide to us when accessing our website. However, we do not warrant and cannot ensure the security of any information that you may provide to us. Information you transmit to us is entirely at your own risk although we undertake to take reasonable steps to preserve such information in a secure manner.
We may use ‘cookies’ on our site. You may refuse the use of cookies by adjusting browser settings.
Our website may use analytic tools that involve transmitting data to third parties in and outside of Australia. This data does not identify individual users.
We may use interfaces with social media sites such as Facebook, Linkedin, Twitter, Instagram and others. If you choose to ‘like’ or ‘share’ information from our website through those services you should review the privacy policy of that service.
